Formation of interim govt valid: Appellate Division

The Supreme Court’s Appellate Division has upheld the High Court’s order declaring both swearing-in and formation of the interim government led by Dr Muhammad Yunus valid.
The court, at the same time, dismissed the leave-to-appeal petition submitted in this regard against the High Court’s judgment.
A seven-member bench of the Appellate Division, headed by Chief Justice Dr Syed Refaat Ahmed, announced the order on Thursday (December 4).
Lawyer Muhammad Mohsen Rashid filed the leave to appeal petition with the Appellate Division on February 25, challenging the HC order.
During Wednesday’s (December 3) hearing, Attorney General Md Asaduzzaman argued that the writ challenging the government’s legality was based on a mistaken notion.
Lawyers representing the government said that the formation of a government following a popular uprising cannot be questioned and that raising doubts before the Supreme Court, which was reconstituted after the government took oath, is impermissible.
